SALEM,MA (WBZ-AM) -- On the stand the alleged victim says he was drinking heavily and took half a Percocet pill on Halloween night in 2016 before he was taken into police protective custody.

He claims that while at the Salem Police Department Officer Brian Butler a twenty four year police veteran and the husband of the Salem's Police Chief fondled him inappropriately and then led him into a broom closet to have sex with him.

Prosecutor Kate McDougal asked him why he couldn't say no:

“I thought if I didn't do what he said then I wasn’t going to get out.”

Defense claims the sex was consensual.

Meanwhile butler's wife filed for divorce last Friday.
